Advocate Gerrie Nel of AfriForum has announced his intention to privately prosecute ANC leader, John Block and his co-directors for gaining forged permits to run a salt mining company, Soutwerke.

Known across the country as the bulldog of prosecution, Nel does not pursue a case if he isn’t sure of winning a conviction. However, this time around, the course of the prosecution will be a little different.

Private prosecutions are only admissible if the National Prosecution Authority (NPA) throws a case out and issues a nolle prosequi certificate that is valid for three months.

This certificate is a declaration made by a prosecutor in a criminal case or by a plaintiff in a civil lawsuit either before or during a trial, meaning the case against the defendant is being dropped.that is valid for three months.

What do we know about John Block?
Block is the ANC’s former chairperson and member of the executive council (MEC) for finance in the Northern Cape.

In an unrelated case, Block is currently on bail, pending his appeal to the Constitutional Court on a 15-year sentence for fraud and money laundering involving the popularly known Trifecta matter.

The two other directors of Soutwerke who are implicated in the case are; former mayor of the Khara Hais local municipality, Gift van Staden, and Andrè Blaauw, a prominent Upington businessman.

The dispute between Soutwerke and Saamwerke
The matter at hand that has occupied Nel’s attention is the dispute been Soutwerke and Saamwerke over which company’s entitled to mine salt on Vrysoutpan, in the Kalahari, between 2008 and 2011.

In 2010, the Northern Cape High Court had ruled that, because Soutwerke’s permit was forged, Saamwerke was the rightful owner of the mining rights.

Gerrie Nel has been asked by the sons of Saamwerke owner, Jalie du Toit, to privately prosecute former ANC leader, John Block and co.
